Terms and Conditions for SoCal Home Heroes

Welcome to SoCal Home Heroes. These Terms and Conditions ("Terms") govern your access to and use of the SoCal Home Heroes websites, mobile applications, and other online services (collectively, the "Platform"), including through our URLs www.socalhomeheroes.com, www.sfvhomeheroes.com, and www.pasadenahomeheroes.com. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use the Platform.
1. Use of the Platform
The Platform is intended for individuals who are at least 18 years old. By accessing or using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You may not use the Platform in any manner that could damage, disable, overburden, or impair the Platform or interfere with any other party's use and enjoyment of the Platform.
2. User Accounts
To access certain features of the Platform, you may be required to create a user account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary to maintain its accuracy.
You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account. You agree to accept responsibility for all activities that occur under your account or password.
3. Service Professionals
Service Professionals are independent contractors and not employees, partners, agents, joint venturers, or franchisees of SoCal Home Heroes. SoCal Home Heroes does not provide, and does not have control over, the services provided by Service Professionals. Any issues or disputes regarding the services provided by a Service Professional should be addressed directly with the Service Professional.
4. Bookings and Payments
When you book a service through the Platform, you agree to pay all charges associated with your booking, including any applicable taxes and fees. SoCal Home Heroes may use third-party payment processors to process payments made through the Platform. Your use of such third-party payment processors is subject to their respective terms and conditions and privacy policies.
5. Cancellations and Refunds
SoCal Home Heroes' cancellation and refund policies may vary depending on the specific service and Service Professional. Please review the applicable cancellation and refund policies before booking a service.
6. User Content
You are solely responsible for any content you post, upload, publish, submit, or transmit on or through the Platform ("User Content"). By submitting User Content, you grant SoCal Home Heroes a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Platform and SoCal Home Heroes' business.
You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to grant the rights granted herein for any User Content you submit.
7. Intellectual Property
The Platform and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by SoCal Home Heroes, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
8. Limitation of Liability
IN NO EVENT SHALL SOCAL HOME HEROES, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE PLATFORM, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE PLATFORM OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
9. Governing Law and Dispute Resolution
SoCal Home Heroes' cancellation and refund policies may vary depending on the specific service and Service Professional. Please review the applicable cancellation and refund policies before booking a service.
10. User Content
These Terms shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law. Any dispute arising out of or relating to these Terms, the Platform, or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Los Angeles County, California. Judgment on the arbitrator's award may be entered in any court having jurisdiction thereof.
Notwithstanding the foregoing, SoCal Home Heroes may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or to prevent any actual or threatened infringement, misappropriation, or violation of its intellectual property or other proprietary rights.
11. Changes to the Terms
SoCal Home Heroes reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use the Platform after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you are no longer authorized to use the Platform.

These Terms constitute the entire agreement between you and SoCal Home Heroes regarding your use of the Platform and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Platform.
